Korea Housing Association Holds Briefing on Revised Construction Appraisal Code of Practice
At a briefing on the 2026 revision of the Construction Appraisal Practice, organized by the Korea Housing Association, Mr. Kim presented and participated in a discussion focusing on the impact of the first revision in 10 years on the practice of defect litigation. He explained the legal issues that the revised repair method, lump sum calculation, and changes in regulations related to waterproofing layers affect the calculation of damages and determination of the scope of liability, and emphasized how to secure the evidentiary value of appraisals and legal risks in the appraisal process.
Mr. Hanbyol presented the importance of site preservation and evidence collection, the importance of selecting an appraiser and setting the appraisal scope, and how to apply the criteria for calculating reasonable repair costs, and made specific suggestions on strengthening contracts and quality control clauses to prevent disputes, as well as evidence submission strategies and negotiation strategies when responding to litigation.
In addition, the authors pointed out the impact of the revisions on future case law formation and the need for coordination between administrative and civil procedures, and provided a guide for practitioners to utilize the revised guidelines as a practical guide by summarizing the issues and countermeasures to be expected when applying the revised guidelines in the field.
