Regarding a case in which a boyfriend borrowed 10 million won ($9,000) and cut off contact with her, saying he was "paying off a loan," Attorney Kim Jeon-soo (Hanbyol Law LLC) explained that the victim's act of informing her mother would not be a problem, as he had directly told her to contact her parents when he stopped contacting her.
Mr. Kim also pointed out the practical limitations of legal remedies and cost recovery. In civil cases, he said, it is difficult to recover the full amount of attorney fees in principle, and even if you win, you can only claim a portion of the fees from the other party as prescribed by law, making it difficult to recover the full amount of actual expenses. He also advised that the actual use of the money and the intention to repay at the time of borrowing are key issues in establishing the crime of fraud, so strategies such as criminal prosecution and civil litigation should be carefully considered.
