After completing a 20-year long-term lease, "I want to stay longer"... but what about those on the waiting list?

Hanbyol Law LLC The attorneys reviewed and provided legal advice focusing on the legal issues arising from the conflict between the clause in the original contract for Seoul Metropolitan Government’s long-term lease housing—which stipulates “a maximum residency period of 20 years and no conversion to ownership”—and the residents’ demands for contract extensions and conversion to ownership. Hanbyol analyzed the finality of the contract, the prohibition on retroactive amendments, public interest, the equity of allocation, and the scope of administrative discretion to clarify the rights and obligations of both residents and applicants on the waiting list, and assessed the potential for legal disputes.

In addition, Hanbyol examined whether SH and the Seoul Metropolitan Government complied with guidelines and procedures, proposed civil and administrative response strategies (negotiation, administrative litigation, civil claims) based on the wording of individual contracts, and presented preventive measures to address anticipated allocation imbalances in the event of future policy changes; it also guided the parties on effective remedies and risk management strategies in the event of a dispute.
