Construction appraisal practice revised after 10 years... Housing associations to hold 15-day briefings
At a briefing for a housing association, Hanbyol Law LLC presented major changes to the Construction Appraisal Practice Act, which has been revised for the first time in 10 years, and how to respond to defect litigation. As the revision has strengthened the appraisal process and standards and increased the evidentiary power of appraisal results and their impact on dispute resolution procedures, he pointed out that securing evidence at the appraisal stage and securing the selection and independence of appraisers are key issues.
As a practical countermeasure, Attorney Hanbyol recommended preliminary maintenance of appraisal and inspection clauses in contracts, preparation of an initial response manual in the event of defects, and establishment of procedures for systematic preservation and supplementation of appraisal data. He also emphasized reviewing the statute of limitations and scope of liability, challenging appraisal results, and establishing litigation and arbitration strategies, and advised that legal preliminary review and establishment of an internal response system are necessary to prepare for changes in practice due to the revision.
