Mocking 'women who will eat bean rice' on Dantok, punished even without names
Heo Eun-seok, a lawyer at Hanbyol Law LLC, explained that even if a real name is not directly mentioned in a group chat room, the specificity of the victim can be recognized by considering the circumstances under which the remarks were made, the relationship between the chat room members, and the circumstances of invitation and eviction. Accordingly, personal attacks and false factual statements, such as 'a woman with full cheeks' or 'eating beans,' are likely to be punishable as defamation or insult under the Information and Communications Network Act.
Mr. Heo emphasized the importance of contextual evidence in criminal cases, noting that even if the case was settled in the past, new acts of insult can be prosecuted as a separate offense, and repetitive behavior can be reflected unfavorably in sentencing. He also noted the need for evidence collection and litigation strategies, such as obtaining a full transcript of the group conversation and pursuing a civil claim for alimony.
