Defective lawsuits and emotional outbursts... "Risk management urgency"
Mr. Hanbyol Law LLC, an attorney at Hanbyol Law LLC, believes that the 2026 revision of the Construction Appraisal Practice of the Central District of Seoul foreshadows significant changes in defect litigation and appraisal practice in general, explaining that appraisal results can make or break a case. The revised sections and enhanced caveats for appraisers are likely to change the standard of practice.
Mr. Hanbyol advised that construction companies should establish a comprehensive risk management system that includes the defect litigation and appraisal stages, not just construction quality management. In particular, to resolve the problem of deviations in appraisal results and appraiser discretion, it is recommended to secure objective test data and data from a third-party testing organization or an architectural professional association, and thoroughly prepare the basis for calculating compensation costs.
In addition, Hanbyol emphasized that lower court judgments are likely to become the standard of practice in the future, and that potential losses should be reduced by monitoring early judgments, establishing an active litigation strategy, appointing appraisers, and preemptively managing evidence.
