'I wrote that'...a 'blame you' qui tam lawsuit after a post is deleted

Jeon Soo Kim, a lawyer at Hanbyol Law LLC, said that the key issue in this case was "proving the existence of deleted posts. He emphasized that deleting a post does not extinguish liability, and that promptly securing and preserving objective evidence, such as screen captures, third-party testimonies, and access records, is crucial to defending against a lawsuit.

Another lawyer from the same Hanbyol explained that it is difficult to view the case as criminal litigation fraud. He pointed out that criminal litigation fraud requires a clear intent to deceive the court and gain financial benefit from the judgment, which has a high burden of proof.

Hanbyol advised prioritizing evidence and legal strategy over emotional responses. He advised to organize objective data such as the existence of posts and contact before and after the deletion, and to consider the possibility of claiming alimony through civil remedies such as counterclaims.
