German Real Estate Fund Facing 'Total Loss' Shows Signs of Escalating into a Legal Dispute
Attorney Lee Seong-woo of Hanbyol Law LLC is acting as legal counsel for Hana Bank investors in their application for mediation regarding damages related to Global Real Estate Investment Trust No. 229 (Trianon Fund), raising the issue of mis-selling as the central point of contention. Attorney Lee pointed out that problems have persisted since numerous overseas real estate funds were launched around 2018 amid a low-interest-rate environment, and that the fund in question lacked sufficient specific explanations regarding its structure, key risks, and the possibility of principal loss. He maintains that this constitutes a classic violation of the suitability principle and the duty to disclose.
Attorney Lee Seong-woo is using these arguments to support investors’ claims for damages (a certain percentage of the loss amount, excluding dividends and other distributions from the investment principal) and is pursuing a strategy to determine liability and the compensation ratio through legal proceedings, even under the current framework of voluntary compensation. It is widely believed that his actions are likely to influence future lawsuits or settlements involving other sales firms.
