Kim Jeon-soo, a lawyer at Hanbyol Law LLC, warned that the key issue in cases where diet pills are prescribed using someone else's name is whether the prescribed drug contains narcotic ingredients, rather than the violation of the Resident Registration Act itself. If the drug is a psychotropic drug containing narcotic substances, he explained, it becomes a violation of the Narcotics Control Act, which can result in much harsher criminal penalties, including up to 10 years in prison or a fine of up to 100 million won.

Kim advises that companies should carefully examine the criminal risks and pay attention to the initial response, rather than focusing on excessive settlement demands. In addition to showing sincere remorse and willingness to prevent recurrence, Kim emphasized the need to prepare a legal response strategy based on whether drugs are involved, so as not to be at a disadvantage during the investigation and prosecution phase.
