Since a provisional measure is an order that prohibits contact regardless of the victim's will, she explained that even if the victim contacted her first, it does not exempt her from liability. Kim also explained that stalking and violation of provisional measures can be prosecuted and punished separately due to different legal interests and establishment requirements, and advised that proving or disputing intentionality, repetition, and causing anxiety is the key to defending against stalking charges. Considering the penalty of a fine of 1 million won and the possibility of referral to the prosecution, the defense should be based on a careful review of the evidence, including relevant text and call records.
