Kim Jeon-soo, a lawyer at Hanbyol Law LLC, determined that an employee who repeatedly professed "I love you" late at night, using the hierarchy in the workplace, was likely to be considered sexual harassment that violated the work environment. In particular, if the remarks continued even after the victim expressed her intention to refuse, she explained, there was enough room for a claim.

Mr. Hanbyol's immigrant lawyer provided specifics on how to obtain evidence. He advised that a clear statement of the victimization, such as "I was uncomfortable with what you said that day, and I would like you not to say it again," and a recording of the statement can prove the victim's refusal and the perpetrator's knowledge. He also emphasized the importance of collecting indirect evidence, such as call logs, messengers, and statements of bystanders.

Hanbyol The lawyers recommended actively utilizing legal remedies such as in-house investigations, complaints to the Labor Office and National Human Rights Commission, and civil damages claims, and seeking legal assistance from the beginning to document and respond to secondary damages (dismissal, disadvantage, bullying, etc.). They added that the court's standard of judgment is whether an "average person" would be humiliated.
